COMMERCIAL CONTRACTS

Under the Tanzanian Law of Contract Act, a contract is concluded by an offer/proposal and the acceptance of that offer. In principle, proposal needs to be communicated. Communication of a proposal is complete when it comes to the knowledge of the person to whom it is made. The proposal may indicate a way in which it is to be accepted. If the proposal is accepted against the way of acceptance as indicated in the proposal, the proposer after acceptance is communicate to him shall within a reasonable time insist the proposal to be accepted in the prescribed manner. If the acceptor fails to accept a proposal in the prescribed manner, then he accepts the acceptance.Once no mode of acceptance is prescribed, the acceptance must be expressed in some usual and reasonable manner.

How can I claim Insurance for my car accident

A comprehensive motor insurance policy typically has two insurance covers bundled together –the third party insurance and the own damages cover. Some also come with a built-in personal accident cover. As the names suggest, the ‘own damages’ and ‘personal accident’ insurance components are to cover your losses i.e. damage to your car or personal injuries, disability and death, respectively. While the above two are optional covers, third-party insurance is compulsory for all vehicle-owners as per the Motor Vehicles Act.
